Companies whose work passes the four-part test can claim the federal research credit (IRC 41), and a company with under $5 million in gross receipts and none in any year before the five-year period ending with the tax year can apply up to $500,000 a year of it against payroll tax. Credits tied to wages include the FICA tip credit, the paid family and medical leave credit, the child care credit and the retirement plan credits on Form 8881. The Work Opportunity Tax Credit does not apply to employees who begin work after December 31, 2025.
Yes, through the payroll election. A qualified small business, with gross receipts under $5 million for the year and none in any year before the five-year period ending with that year, can elect on its timely filed original return to apply up to $500,000 a year of research credit against the employer share of Social Security tax and then Medicare tax, claimed with each Form 941 on Form 8974. The election cannot be made on an amended return.
Generally within 3 years from the date the return was filed or 2 years from the date the tax was paid, whichever is later (IRC 6511), on an amended return that includes Form 6765 and the required claim information. A recovered credit reduces income tax or carries forward; the payroll election is not available on an amended return.
