Fitness Studios & Gyms: State Payroll Compliance Issues (2026)

State payroll compliance for fitness businesses layers each state's wage floor, overtime rule, pay frequency law, new hire deadline and final pay rule on the federal rules cited on this page, and fitness businesses carry industry-specific state duties on top. BEG runs fitness business payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Where state law touches fitness businesses specifically

A commissioned trainer can be exempt from overtime under FLSA section 7(i) only if three conditions are met: the employer is a retail or service establishment, the employee's regular rate exceeds one and one-half times the minimum wage for every hour worked in any week with overtime, and more than half of total earnings in a representative period of one month to one year are commissions. If any condition fails, overtime is due at time and one-half for hours over 40.

Employees must report cash tips to the employer in a written statement by the 10th day of the following month unless total tips from that employer are under $20 for the month. The employer must withhold income tax and the employee share of Social Security and Medicare tax on reported tips and pay the employer share.

Tips paid by customers can never be counted as commissions for the section 7(i) exemption, and a retail or service establishment is one where 75 percent of annual dollar volume is not for resale and is recognized as retail in the industry. Mandatory service charges paid to service employees may count as commissions.

The state layer every employer carries

Each state where an employee of a fitness business works can set its own minimum wage, its own overtime trigger, a pay-frequency law, a new hire reporting deadline shorter than the federal 20 days, a final paycheck deadline, and a continuation coverage rule below the federal COBRA threshold. The state pages on this site carry those facts state by state from one data file, so the numbers here and on the multi-state checker never disagree.

Frequently Asked Questions

Which state rules hit fitness businesses hardest?

A commissioned trainer can be exempt from overtime under FLSA section 7(i) only if three conditions are met: the employer is a retail or service establishment, the employee's regular rate exceeds one and one-half times the minimum wage for every hour worked in any week with overtime, and more than half of total earnings in a representative period of one month to one year are commissions. If any condition fails, overtime is due at time and one-half for hours over 40.

Does a fitness business need a separate state account for every state with an employee?

Yes, in most cases two: a withholding account, unless the state has no wage tax, and an unemployment insurance account. Under the localization of work rules, unemployment tax for a remote employee goes to the state where the work is performed.

What does managed payroll cost for a fitness business?

$45 per employee per month, all-inclusive, inside the payroll software you already use, with no monthly minimum. Trainer 1099 vs W-2 classification, commission-based training pay and class-based instructor pay are configured at setup, not billed as add-ons.
