Fitness Studios & Gyms: Employee Classification for Payroll (2026)

Employee classification in fitness businesses is two questions: whether personal trainers and group fitness instructors are employees or contractors, and whether the employees are exempt from overtime. BEG runs fitness business payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how fitness businesses get it wrong

Under the FLSA a trainer is an employee if the economic realities show they are economically dependent on the gym for work, judged on the whole relationship. Signing an independent contractor agreement or being paid on a 1099 does not make a trainer an independent contractor.

For federal employment taxes, the IRS decides whether a trainer is an employee or a contractor using common law rules grouped as behavioral control, financial control and type of relationship, with no set number of factors. If status is unclear, either the business or the worker can file Form SS-8 for an IRS determination.

Exempt or non-exempt

A commissioned trainer can be exempt from overtime under FLSA section 7(i) only if three conditions are met: the employer is a retail or service establishment, the employee's regular rate exceeds one and one-half times the minimum wage for every hour worked in any week with overtime, and more than half of total earnings in a representative period of one month to one year are commissions. If any condition fails, overtime is due at time and one-half for hours over 40.

The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Exercise trainers and group fitness instructors at the May 2025 national median of $47,160 a year clear that salary test, so the duties test decides.

What misclassification costs

Employees must report cash tips to the employer in a written statement by the 10th day of the following month unless total tips from that employer are under $20 for the month. The employer must withhold income tax and the employee share of Social Security and Medicare tax on reported tips and pay the employer share.

Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
