Cannabis Businesses: State Payroll Compliance Issues (2026)
State payroll compliance for cannabis businesses layers each state's wage floor, overtime rule, pay frequency law, new hire deadline and final pay rule on the federal rules cited on this page, and cannabis businesses carry industry-specific state duties on top. BEG runs cannabis business payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Where state law touches cannabis businesses specifically
The FLSA overtime exemption for agriculture applies only to work within the Act's definition of agriculture, which includes the cultivation, growing and harvesting of agricultural or horticultural commodities. Employees whose jobs relate to agriculture but fall outside that definition, such as packing commodities produced on a different farm, must be paid overtime, and agricultural employees must still receive at least the federal minimum wage.
An employee who customarily and regularly receives more than $30 a month in tips is a tipped employee under the FLSA. An employer may pay a cash wage of at least $2.13 per hour and take a tip credit of up to $5.12 per hour toward the $7.25 minimum wage, must give the employee notice before taking the credit, and may never keep any portion of employee tips.
IRC section 280E disallows all deductions or credits for a business that traffics in marijuana, even where the sales are legal under state law, but the business may still reduce gross receipts by cost of goods sold calculated under section 471. A dispensary may not deduct advertising or selling expenses.
The state layer every employer carries
Each state where an employee of a cannabis business works can set its own minimum wage, its own overtime trigger, a pay-frequency law, a new hire reporting deadline shorter than the federal 20 days, a final paycheck deadline, and a continuation coverage rule below the federal COBRA threshold. The state pages on this site carry those facts state by state from one data file, so the numbers here and on the multi-state checker never disagree.

Frequently Asked Questions
Which state rules hit cannabis businesses hardest?
The FLSA overtime exemption for agriculture applies only to work within the Act's definition of agriculture, which includes the cultivation, growing and harvesting of agricultural or horticultural commodities. Employees whose jobs relate to agriculture but fall outside that definition, such as packing commodities produced on a different farm, must be paid overtime, and agricultural employees must still receive at least the federal minimum wage.
Does a cannabis business need a separate state account for every state with an employee?
Yes, in most cases two: a withholding account, unless the state has no wage tax, and an unemployment insurance account. Under the localization of work rules, unemployment tax for a remote employee goes to the state where the work is performed.
What does managed payroll cost for a cannabis business?
$45 per employee per month, all-inclusive, inside the payroll software you already use, with no monthly minimum. 280E tax code payroll deductions, cash payroll documentation and state cannabis board reporting are configured at setup, not billed as add-ons.
