Cannabis Businesses: Employee Classification for Payroll (2026)

Employee classification in cannabis businesses is two questions: whether budtenders and growers are employees or contractors, and whether the employees are exempt from overtime. BEG runs cannabis business payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how cannabis businesses get it wrong

DOL decides employee or independent contractor status under the FLSA by an economic reality test that looks at profit or loss opportunity, investments, permanence, control, whether the work is integral to the business, and skill and initiative. A worker's title, payment by 1099, or a signed independent contractor agreement does not make the worker an independent contractor, and DOL published a new proposed rule on this status on February 26, 2026.

Exempt or non-exempt

The FLSA overtime exemption for agriculture applies only to work within the Act's definition of agriculture, which includes the cultivation, growing and harvesting of agricultural or horticultural commodities. Employees whose jobs relate to agriculture but fall outside that definition, such as packing commodities produced on a different farm, must be paid overtime, and agricultural employees must still receive at least the federal minimum wage.

The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Retail salespersons at the May 2025 national median of $35,410 a year earn under it on a weekly basis, so the role is non-exempt on salary alone whatever the duties.

What misclassification costs

Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
