Tennessee Paid Sick Leave Explained: Where the State Does Legislate

Tennessee requires no paid sick leave, and it has no state minimum wage law either, so federal law supplies the floor. It does require paid jury duty leave at employers with five or more employees, and its health continuation statute runs longer than most, up to fifteen months in the case of divorce or death.

Tennessee legislates very little about employment, and that shows up twice on the same page: there is no paid sick leave requirement and there is no state minimum wage law. Federal law supplies the wage floor and the handbook supplies the leave.

Where Tennessee does legislate, it is unusually detailed. The jury duty statute at Tenn. Code section 22-4-106 carries a pay rule, an employer-size threshold, a length-of-service test and a set of shift rules, which is more specificity than most states apply to any leave at all.

The five-employee jury duty threshold

Tennessee requires an employer to pay usual compensation minus the juror fee during jury service, with two exceptions: employers with fewer than five employees, and employees who have been temporary for less than six months. That gives Tennessee a paid leave obligation with a size threshold, at a point where it has no sick leave obligation at any size.

The shift rules matter as much as the pay rule. An employee must be excused for any day on which service runs past three hours, and a night-shift employee is excused from the shift before their first day of service and from the next scheduled shift within 24 hours of any later long day. Enforcement reaches reinstatement, lost wages and benefits, and the offence is a Class A misdemeanour.

No state minimum wage, and what follows

With no state wage statute, the federal Fair Labor Standards Act floor is the only one, and it reaches only employers and employees federal law covers, generally an enterprise at or above the federal annual sales threshold or an employee engaged in interstate commerce.

For leave policy that has one practical effect. Any paid time a Tennessee employer chooses to provide is valued at whatever rate it actually pays, with no state floor shaping it, and the same is true of the jury duty payment the state does require. The rate question and the entitlement question are decided by two different bodies of law.

Continuation coverage runs longer than usual

Tenn. Code Ann. section 56-7-2312 applies to fully insured group hospital, surgical and major medical policies issued in Tennessee regardless of employer size, which is broader than the sub-20 framing most states use. General continuation runs for the remainder of the policy month plus three further months.

Where the trigger is divorce or the death of an insured spouse, the extension runs up to fifteen months. A Tennessee employer therefore has a longer tail on some continuation events than most, and it is the event-specific length rather than the headline figure that decides what notice has to say.

What the policy is actually doing here

In a state with no sick leave statute, the handbook is the obligation in full. What it says about carryover, about payout at separation and about availability during a probation period will be applied as written, because there is no statutory default sitting behind it to fill a silence.

The larger risk is outside Tennessee. Twenty states and the District of Columbia do mandate paid sick leave, and the obligation follows the employee's work location. A Nashville or Memphis business with one remote hire in a mandate state has acquired an accrual and notice duty there with nothing in its own handbook to extend, which is the point at which HR outsourcing stops being optional.

FMLA, remote-hire exposure and voluntary policy drafting: paid leave fundamentals.

For Tennessee specifically: nothing above is statutory in Tennessee, so your written policy is the enforceable rule, the wage floor those hours are paid at is Federal $7.25 (no state minimum wage law), and below the federal 20-employee COBRA threshold Tennessee still requires continuation coverage for up to 15 months. HR outsourcing in Tennessee keeps that in the handbook and in payroll.

Frequently Asked Questions

Does Tennessee require paid sick leave?

No. Tennessee has no statewide requirement for private employers, so whatever your handbook says is the enforceable rule, including on carryover and payout. Hours you do pay are paid at Federal $7.25 (no state minimum wage law).

What pay rate applies to leave hours in Tennessee?

Minimum wage in Tennessee is Federal $7.25 (no state minimum wage law). Overtime: Federal FLSA rules (weekly over 40). Paid leave hours generally do not count toward the overtime threshold because they are not hours worked.

Does health coverage continue after separation in Tennessee?

Federal COBRA applies at 20 or more employees. Below that, Tennessee has its own continuation law, the Tennessee Continuation of Terminated Group Coverage, running up to 15 months (Tenn. Code Ann. section 56-7-2312 (Continuation of terminated group coverage; conversion)).

Do Tennessee employers have to pay for jury duty leave?

Usual compensation minus the juror fee, unless the employer has fewer than five employees or the employee has been temporary for under six months. The employee must be excused for any day service runs past three hours. A night-shift employee is excused from the shift before their first day of service, and from the next scheduled shift within 24 hours of any later day that runs past three hours. Getting it wrong costs: Reinstatement, lost wages and benefits; Class A misdemeanour (Tenn. Code § 22-4-106).

Does Tennessee run a paid family and medical leave programme?

No. Federal FMLA is the only family and medical leave floor in Tennessee: 12 workweeks, unpaid, at employers with 50 or more employees.

Does Tennessee require paid jury duty leave?

Yes, conditionally. Tenn. Code section 22-4-106 requires usual compensation minus the juror fee, unless the employer has fewer than five employees or the employee has been temporary for less than six months. So the same absence is paid at a six-person employer and unpaid at a four-person one, which is the opposite pattern to the sick leave position where nobody owes anything.

What is the Tennessee night-shift jury duty rule?

An employee must be excused from work for any day on which service runs more than three hours. For a night-shift employee the statute goes further: they are excused from the shift immediately before their first day of service, and from the next scheduled shift within 24 hours of any later day that runs past three hours. It is a scheduling rule, so it belongs in the rota rather than only in the handbook.

Does Tennessee have a state minimum wage?

No. Tennessee is one of a handful of states with no minimum wage statute at all, so the federal Fair Labor Standards Act floor applies to covered employers. For a leave policy that matters because the wage rate is what any voluntary paid time is worth, and because it reaches only employees and businesses federal law covers.

How long does Tennessee continuation coverage last?

General continuation under Tenn. Code Ann. section 56-7-2312 runs for the remainder of the policy month plus three further months for someone continuously insured for at least three months beforehand. Where the trigger is divorce or the death of an insured spouse the extension runs up to fifteen months, which is longer than most state continuation laws reach.
