Alabama Paid Sick Leave Explained: The One Leave You Must Pay For
Alabama requires no paid sick leave, so the written policy is the enforceable rule. It is also one of the few states that requires jury duty leave to be paid at usual wages, under Ala. Code section 12-16-8, and it has no state health continuation law at all below the federal COBRA threshold.

Alabama has no paid sick leave statute, and there is no useful way to make that fact longer than it is. What is worth an employer's attention is the leave Alabama does require, because it runs the opposite way to most of the country: jury service must be paid, and sick leave need not be.
Alabama at a glance
| Paid sick leave mandate | None statewide for private employers |
|---|---|
| Governing rule | Your written policy, enforced as written |
| State paid family and medical leave | None. Federal FMLA only, unpaid, at 50+ employees |
| Minimum wage | Federal $7.25 (no state minimum wage law) |
| Overtime | Federal FLSA rules (weekly over 40) |
| Jury duty leave, paid? | Usual pay, for every day of service. [Ala. Code § 12-16-8] |
| Jury duty, the part missed | An employee cannot be asked to use annual, vacation, sick or unpaid leave for jury service, and must report for the next regularly scheduled hour after dismissal to keep the protection. Courts reschedule service where the employer has five or fewer employees and another employee is already summoned. |
| Jury duty penalty | Actual and punitive damages. |
| Coverage below the 20-employee COBRA line | None. No state obligation under 20 employees |
Jury duty is paid leave in Alabama
Ala. Code section 12-16-8 requires an employer to pay an employee their usual wages for every day of jury service. It also bars the employer from requiring the employee to draw on annual, vacation, sick or unpaid leave for it, so the paid day sits on top of any balance rather than inside it.
Two further details belong in the policy. The employee has to report for the next regularly scheduled working hour after being dismissed from service to keep the protection, and the courts will reschedule service where the employer has five or fewer employees and another employee is already summoned. The remedy for getting it wrong reaches actual and punitive damages, which is a heavier exposure than most jury duty statutes carry.
No continuation law at all
Alabama is one of only two states with no general health coverage continuation statute. Federal COBRA reaches employers with 20 or more employees. Below that line, an Alabama employer owes nothing after a separation unless the plan document or the handbook says otherwise.
That absence matters more than it sounds. In most states a small employer that ends someone's employment has a state continuation notice to issue. In Alabama there is nothing to issue, which means whatever the employer chose to write into its own documents is the entire obligation, and an unconsidered sentence promising continued coverage is enforceable with no statute behind it to shape the terms.
What the handbook has to do instead
With no sick leave statute and no continuation statute, the written policy is doing all the work in Alabama. The failures that follow are the same ones every no-mandate state produces, and they are drafting failures rather than compliance ones: a promise to pay out unused balances that nobody intended to make, an undefined carryover rule, and silence on whether leave is available during a probationary period.
The Alabama-specific addition is jury duty. A handbook that lists jury service among the unpaid absences, which is the default in most national templates, is wrong in the one place Alabama actually legislates.
The exposure is the out-of-state hire
Twenty states and the District of Columbia mandate paid sick leave, and the obligation follows the place the employee works. An Alabama business that hires one person in Illinois, Colorado or New Jersey acquires that state's full accrual, notice and record-keeping rules for them, with nothing in the Alabama handbook to extend.
That is the realistic risk here, rather than anything happening inside Alabama. HR outsourcing is what puts a compliant policy in place for the state the person actually works in, before the first accrual period closes rather than after it.
FMLA, remote-hire exposure and voluntary policy drafting: paid leave fundamentals.
For Alabama specifically: nothing above is statutory in Alabama, so your written policy is the enforceable rule, the wage floor those hours are paid at is Federal $7.25 (no state minimum wage law), and below the federal 20-employee COBRA threshold there is no Alabama continuation requirement at all. HR outsourcing in Alabama keeps that in the handbook and in payroll.

Frequently Asked Questions
Does Alabama require paid sick leave?
No. Alabama has no statewide requirement for private employers, so whatever your handbook says is the enforceable rule, including on carryover and payout. Hours you do pay are paid at Federal $7.25 (no state minimum wage law).
What pay rate applies to leave hours in Alabama?
Minimum wage in Alabama is Federal $7.25 (no state minimum wage law). Overtime: Federal FLSA rules (weekly over 40). Paid leave hours generally do not count toward the overtime threshold because they are not hours worked.
Does health coverage continue after separation in Alabama?
Only federal COBRA, at 20 or more employees. Alabama has no state continuation law, so a smaller employer owes nothing after separation unless the handbook promises it.
Do Alabama employers have to pay for jury duty leave?
Usual pay, for every day of service. An employee cannot be asked to use annual, vacation, sick or unpaid leave for jury service, and must report for the next regularly scheduled hour after dismissal to keep the protection. Courts reschedule service where the employer has five or fewer employees and another employee is already summoned. Getting it wrong costs: Actual and punitive damages (Ala. Code § 12-16-8).
Does Alabama run a paid family and medical leave programme?
No. Federal FMLA is the only family and medical leave floor in Alabama: 12 workweeks, unpaid, at employers with 50 or more employees.
Which leave does Alabama actually require an employer to pay for?
Jury service. Ala. Code section 12-16-8 requires usual pay for every day of service, which makes Alabama one of a small group of states where jury duty is paid leave by statute while sick leave is not. An Alabama handbook that treats jury duty as unpaid time off has the only paid leave obligation in the state the wrong way round.
Can an Alabama employer make an employee use vacation for jury duty?
No. The statute prohibits requiring an employee to use annual, vacation, sick or unpaid leave for jury service, so the paid day is additional to whatever balance the employee holds. Getting this wrong is not a technicality: the remedy reaches actual and punitive damages.
Does Alabama have a state continuation or mini-COBRA law?
No. Alabama is one of only two states in this data set with no general state continuation statute, alongside Idaho. Below the federal 20-employee COBRA threshold an Alabama employer owes nothing after separation unless the handbook or the plan document promises it, which puts more weight on what those documents say than in most states.
Can an Alabama city require paid sick leave?
No city currently does. Alabama has a statewide framework that voids local employment mandates of this kind, and no Alabama municipality operates a paid sick leave ordinance. The state-level answer is therefore the whole answer everywhere in Alabama.
