Retail Businesses: State Payroll Compliance Issues (2026)

State payroll compliance for retail businesses layers each state's wage floor, overtime rule, pay frequency law, new hire deadline and final pay rule on the federal rules cited on this page, and retail businesses carry industry-specific state duties on top. BEG runs retail business payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Where state law touches retail businesses specifically

Commissioned employees of a retail or service establishment are exempt from overtime under section 7(i) only when three conditions are met: the employee works for a retail or service establishment, the regular rate exceeds one and one-half times the minimum wage for every hour worked in an overtime week, and more than half of total earnings in a representative period of one month to one year are commissions. If any condition fails, overtime is owed at time and one-half for hours over 40.

Employers may pay a youth minimum wage of not less than $4.25 an hour to employees under 20 years of age during their first 90 consecutive calendar days of employment. Employers may not displace other employees to hire at the youth wage, and a higher state or local minimum wage with no youth exception applies instead.

Workers aged 14 and 15 may work in retail jobs such as cashiering, bagging groceries, and stocking shelves, but only outside school hours, no more than 3 hours on a school day, 18 hours in a school week, 8 hours on a nonschool day, 40 hours in a nonschool week, and between 7 a.m. and 7 p.m. (9 p.m. from June 1 through Labor Day). Workers under 18 may not operate balers or compactors, and 16- and 17-year-olds may only load certain scrap paper balers under specific rules.

The state layer every employer carries

Each state where an employee of a retail business works can set its own minimum wage, its own overtime trigger, a pay-frequency law, a new hire reporting deadline shorter than the federal 20 days, a final paycheck deadline, and a continuation coverage rule below the federal COBRA threshold. The state pages on this site carry those facts state by state from one data file, so the numbers here and on the multi-state checker never disagree.

Frequently Asked Questions

Which state rules hit retail businesses hardest?

Commissioned employees of a retail or service establishment are exempt from overtime under section 7(i) only when three conditions are met: the employee works for a retail or service establishment, the regular rate exceeds one and one-half times the minimum wage for every hour worked in an overtime week, and more than half of total earnings in a representative period of one month to one year are commissions. If any condition fails, overtime is owed at time and one-half for hours over 40.

Does a retail business need a separate state account for every state with an employee?

Yes, in most cases two: a withholding account, unless the state has no wage tax, and an unemployment insurance account. Under the localization of work rules, unemployment tax for a remote employee goes to the state where the work is performed.

What does managed payroll cost for a retail business?

$45 per employee per month, all-inclusive, inside the payroll software you already use, with no monthly minimum. High turnover and new-hire volume, multi-location payroll and seasonal overtime spikes are configured at setup, not billed as add-ons.
