Real Estate Agencies: State Payroll Compliance Issues (2026)

State payroll compliance for real estate brokerages layers each state's wage floor, overtime rule, pay frequency law, new hire deadline and final pay rule on the federal rules cited on this page, and real estate brokerages carry industry-specific state duties on top. BEG: $45 per employee per month inside the payroll software you already use, live in 3 to 5 days.

Where state law touches real estate brokerages specifically

The outside sales exemption from minimum wage and overtime requires that the employee's primary duty be making sales or obtaining orders or contracts, and that the employee be customarily and regularly engaged away from the employer's place of business. The salary requirements of the regulation do not apply to this exemption.

Licensed real estate agents are statutory nonemployees treated as self-employed for all federal tax purposes, including income and employment taxes, if substantially all payments for their services are directly related to sales or other output rather than hours worked, and their services are performed under a written contract stating they will not be treated as employees for federal tax purposes.

Section 3508 of the Internal Revenue Code provides that a qualified real estate agent is not treated as an employee and the person paying for the services is not treated as an employer for federal tax purposes. Qualification requires a real estate license, remuneration tied to sales or output rather than hours worked, and a written contract providing non-employee treatment.

The state layer every employer carries

Each state where an employee of a real estate brokerage works can set its own minimum wage, its own overtime trigger, a pay-frequency law, a new hire reporting deadline shorter than the federal 20 days, a final paycheck deadline, and a continuation coverage rule below the federal COBRA threshold. The state pages on this site carry those facts state by state from one data file, so the numbers here and on the multi-state checker never disagree.

Frequently Asked Questions

Which state rules hit real estate brokerages hardest?

The outside sales exemption from minimum wage and overtime requires that the employee's primary duty be making sales or obtaining orders or contracts, and that the employee be customarily and regularly engaged away from the employer's place of business. The salary requirements of the regulation do not apply to this exemption.

Does a real estate brokerage need a separate state account for every state with an employee?

Yes, in most cases two: a withholding account, unless the state has no wage tax, and an unemployment insurance account. Under the localization of work rules, unemployment tax for a remote employee goes to the state where the work is performed.

What does managed payroll cost for a real estate brokerage?

$45 per employee per month, all-inclusive, inside the payroll software you already use, with no monthly minimum. Commission-only agent payroll, agent contractor vs W-2 classification and split commission processing are configured at setup, not billed as add-ons.
