Real Estate Agencies: Overtime Rules and Payroll Compliance (2026)

Overtime in real estate brokerages is time and one half after 40 hours on the regular rate, and the regular rate has to absorb commission-only agent payroll and agent contractor vs W-2 classification before the premium is applied. BEG runs real estate brokerage payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

The overtime rules that apply to real estate brokerages

The outside sales exemption from minimum wage and overtime requires that the employee's primary duty be making sales or obtaining orders or contracts, and that the employee be customarily and regularly engaged away from the employer's place of business. The salary requirements of the regulation do not apply to this exemption.

Administrative and office staff who do not meet an exemption must receive overtime at one and one-half times the regular rate for hours over 40 in a workweek. The standard salary level for the executive, administrative, and professional exemptions is $684 per week ($35,568 per year).

Any fixed site, including a home office, that a salesperson uses as a headquarters or for telephone solicitation is treated as one of the employer's places of business. Sales made by mail, telephone, or the Internet do not count as outside sales unless that contact is only an adjunct to personal calls.

A worked example at real estate brokerage wages

Real estate sales agents at the May 2025 national median of $52,830 earn about $25 an hour on a 2,080-hour year. Ten overtime hours in a week cost $381 at time and one half. If that week also carried commission-only agent payroll, the amount folds into the regular rate first and the premium rises with it; leaving it out is the most common overtime error in this industry.

How the payroll is set up to get it right

Each pay component is flagged at setup as included in or excluded from the regular rate, hours are captured by workweek rather than pay period, and any industry exemption is applied per employee with the supporting record kept. Overtime is then arithmetic, not judgment, on every run.
