Real Estate Agencies: Employee Classification for Payroll (2026)

Employee classification in real estate brokerages is two questions: whether licensed agents and administrative staff are employees or contractors, and whether the employees are exempt from overtime. BEG runs real estate brokerage payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how real estate brokerages get it wrong

Section 3508 of the Internal Revenue Code provides that a qualified real estate agent is not treated as an employee and the person paying for the services is not treated as an employer for federal tax purposes. Qualification requires a real estate license, remuneration tied to sales or output rather than hours worked, and a written contract providing non-employee treatment.

Under the FLSA, employee or independent contractor status is decided by the economic realities of the working relationship, not by labels. Receiving a 1099, signing an independent contractor agreement, or holding a state license does not by itself make a worker an independent contractor for FLSA purposes. The fact sheet notes the 2024 rule is subject to litigation and refers to Field Assistance Bulletin 2025-1 for the Wage and Hour Division's enforcement position.

Exempt or non-exempt

The outside sales exemption from minimum wage and overtime requires that the employee's primary duty be making sales or obtaining orders or contracts, and that the employee be customarily and regularly engaged away from the employer's place of business. The salary requirements of the regulation do not apply to this exemption.

The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Real estate sales agents at the May 2025 national median of $52,830 a year clear that salary test, so the duties test decides.

What misclassification costs

Licensed real estate agents are statutory nonemployees treated as self-employed for all federal tax purposes, including income and employment taxes, if substantially all payments for their services are directly related to sales or other output rather than hours worked, and their services are performed under a written contract stating they will not be treated as employees for federal tax purposes.

Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
