Engineering & Professional Services Firms: Employee Classification for Payroll (2026)
Employee classification in engineering firms is two questions: whether engineers and project managers are employees or contractors, and whether the employees are exempt from overtime. BEG runs engineering firm payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how engineering firms get it wrong
Under Davis-Bacon regulations, the term laborer or mechanic covers workers whose duties are manual or physical; workers whose duties are primarily administrative, executive or clerical, and persons employed in a bona fide executive, administrative or professional capacity under 29 CFR part 541, are not laborers or mechanics. Forepersons who spend more than 20 percent of a workweek on laborer or mechanic duties are covered for that time.
Engineering technicians are named in Fact Sheet #17O as technicians who generally do not meet the learned professional exemption and so are not exempt from FLSA minimum wage and overtime.
Exempt or non-exempt
Engineering is listed as a field of science or learning for the learned professional exemption, so engineers whose primary duty requires advanced knowledge acquired through prolonged specialized instruction and who are paid on a salary or fee basis at the standard salary level are exempt from overtime. Job titles alone do not determine exemption status.
The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Civil engineers at the May 2025 national median of $100,840 a year clear that salary test, so the duties test decides.
What misclassification costs
Firms that engage individual engineers or drafters as contractors must apply the IRS common law rules on behavioral control, financial control and type of relationship; if status is unclear, either the business or the worker can file Form SS-8 for an IRS determination, which may take at least six months.
Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
