Agency Payroll: The Truth About Overtime Rules | BEGce (2026)

Overtime in marketing agencies is time and one half after 40 hours on the regular rate, and the regular rate has to absorb 1099 vs W-2 freelancer classification and project-based bonuses before the premium is applied. BEG runs marketing agency payroll for $25 per employee per month in your existing platform or $45 on isolved, all-inclusive, live in 3 to 5 business days.

The overtime rules that apply to marketing agencies

Whether a freelancer is an employee or an independent contractor under the FLSA is decided by the economic reality of the whole relationship using six factors: opportunity for profit or loss, investments, permanence, control, whether the work is integral to the business, and skill and initiative. Signing a contractor agreement or receiving a 1099 does not make a worker a contractor.

The 2024 independent contractor rule is still codified at 29 CFR part 795 (source 89 FR 1741, January 10, 2024) and remains in effect for private litigation, but the Wage and Hour Division stopped applying it in its own investigations under Field Assistance Bulletin 2025-1. On February 26, 2026 DOL proposed rescinding it in favor of a test built on two core factors, control and opportunity for profit or loss; the comment period closed April 28, 2026 and no final rule was posted as of this research.

Copywriters, designers and other creative staff can be exempt creative professionals only if paid a salary of at least $684 per week and their primary duty requires invention, imagination, originality or talent in a recognized artistic or creative field. Work that mainly depends on intelligence, diligence and accuracy does not qualify, and the test is applied case by case.

A worked example at marketing agency wages

Market research analysts and marketing specialists at the May 2025 national median of $78,760 earn about $38 an hour on a 2,080-hour year. Ten overtime hours in a week cost $568 at time and one half. If that week also carried 1099 vs W-2 freelancer classification, the amount folds into the regular rate first and the premium rises with it; leaving it out is the most common overtime error in this industry.

How the payroll is set up to get it right

Each pay component is flagged at setup as included in or excluded from the regular rate, hours are captured by workweek rather than pay period, and any industry exemption is applied per employee with the supporting record kept. Overtime is then arithmetic, not judgment, on every run.
