Agency Payroll: The Truth About Classification | BEG (2026)
Employee classification in marketing agencies is two questions: whether account managers and copywriters are employees or contractors, and whether the employees are exempt from overtime. BEG runs marketing agency payroll for $25 per employee per month in your existing platform or $45 on isolved, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how marketing agencies get it wrong
A graphic designer who uses the firm's software, computer and office space and works only on assignments the firm finds is an employee under the investment factor, while a designer who buys their own software and equipment, rents space and markets services to multiple clients shows independent contractor status.
Whether a writer or designer is an exempt creative professional turns on how much invention, imagination, originality or talent the work requires; staff who only collect, organize and record routine or already public information without unique interpretation do not qualify.
Exempt or non-exempt
Copywriters, designers and other creative staff can be exempt creative professionals only if paid a salary of at least $684 per week and their primary duty requires invention, imagination, originality or talent in a recognized artistic or creative field. Work that mainly depends on intelligence, diligence and accuracy does not qualify, and the test is applied case by case.
The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Market research analysts and marketing specialists at the May 2025 national median of $78,760 a year clear that salary test, so the duties test decides.
What misclassification costs
The IRS decides employee versus contractor status under common law rules grouped into three categories: behavioral control, financial control and the type of relationship. There is no set number of factors and no single factor decides, and a remote worker is an employee if the business has the right to control what will be done and how. Form SS-8 can be filed for an IRS determination.
Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
