Healthcare Practices: Payroll Compliance Guide (2026)
Payroll compliance for healthcare practices rests on the federal rules that reach this industry specifically, 4 of which are cited on this page, plus the deposit and filing duties every employer carries. BEG runs healthcare practice payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

The rules that reach healthcare practices specifically
Hospitals and residential care establishments may compute overtime over a fixed 14 consecutive day work period instead of the 40 hour workweek, paying time and one half for hours over 8 in a day and over 80 in the period. The employer must have a prior agreement or understanding with the affected employees before the work is performed, and cannot use both systems for the same employee.
Shift differentials and non-discretionary bonuses such as attendance, retention and supplementary shift bonuses must be added into the regular rate before the overtime premium is computed. Paying time and one half of the base hourly rate alone is a violation when differentials are paid.
When an employee works two jobs at different rates in one workweek, such as a nurse aide who also covers reception, overtime may be computed on the weighted average of the rates, or at time and one half the rate for the work performed during the overtime hours if agreed in advance.
On-call time counts as hours worked only when the employee must remain on or so near the premises that the time cannot be used for their own purposes; carrying a cell phone and staying within 45 minutes of the facility is generally not hours worked. Automatic 30 minute meal deductions are allowed only if the employee is completely relieved of duty.
The duties every employer carries
Federal income tax withholding, Social Security and Medicare, FUTA, deposits on the monthly or semiweekly schedule the lookback period sets, quarterly Form 941, annual W-2s and, for healthcare practices paying contractors, 1099-NEC at the $2,000 threshold in force for tax years after 2025. A late deposit starts at a 2 percent failure-to-deposit penalty and climbs to 15 percent.
HIPAA covered entities must train every workforce member on their privacy policies, train each new hire within a reasonable period after joining, document that the training was provided, and retain that documentation for 6 years from creation or the date it was last in effect.
