Financial Services & Accounting Firms: Employee Classification for Payroll (2026)

Employee classification in financial services firms is two questions: whether financial advisors and CPAs are employees or contractors, and whether the employees are exempt from overtime. BEG runs financial services firm payroll for $45 per employee per month inside the payroll software you already use, all-inclusive, live in 3 to 5 business days.

Employee or contractor: how financial services firms get it wrong

Exempt or non-exempt status for financial advisors and similar staff is based on the duties they actually perform, not on job title or on whether the customer is an end user or an intermediary. An employee whose primary duty is selling financial products does not qualify for the administrative exemption.

For federal employment taxes, the IRS decides employee versus independent contractor status using common law rules grouped into behavioral control, financial control and type of relationship, and no single factor or set number of factors decides the outcome. Either the firm or the worker can file Form SS-8 to request an IRS determination, which can take at least six months.

Exempt or non-exempt

Financial services employees generally meet the administrative exemption duties test when their work includes collecting and analyzing a customer's income, assets, investments or debts, determining which financial products fit, and advising on their advantages and disadvantages. An employee whose primary duty is selling financial products does not qualify for the administrative exemption.

The salary floor for the executive, administrative and professional exemptions is $684 a week, restored to the 2019 level after the 2024 rule was vacated. Personal financial advisors at the May 2025 national median of $105,070 a year clear that salary test, so the duties test decides.

What misclassification costs

If a nonqualified deferred compensation plan fails section 409A, the deferred amounts become includible in the employee's income, are reported on Form W-2 box 12 code Z, and are subject to an additional 20% income tax plus a premium interest tax, both assessed on the employee. Amounts that are substantially vested and paid no later than March 15 of the following year fall under the short-term deferral exception and are not subject to section 409A.

Reclassifying a contractor as an employee means back FICA at 15.3 percent split between the parties, back FUTA, penalties and interest, and often back overtime under the FLSA at time and one half for two or three years.
