Prevailing Wage and Certified Payroll: What Employers Must Know
Davis-Bacon applies to federally funded construction contracts over $2,000 and requires the locally prevailing wage plus fringe benefits. Certified payroll goes to the contracting agency every week with a signed Statement of Compliance. Miss labor classification tracking and every hour on that job defaults to the highest rate. BEG runs that weekly record at $45 per employee monthly.
Davis-Bacon Turns On at $2,000
The classification mistake that costs the most
Contractors on a Davis-Bacon job lose money on one mistake more than any other: not tracking hours by labor classification. If a worker performs two different classified tasks in a day and the hours are not split between them, the entire day defaults to the highest applicable rate for any of that work, not a blended average. A carpenter who spends two hours on electrical work and six on carpentry, with no split recorded, gets paid the higher electrician rate for all eight hours. That is not a rounding error, it is the rule.
What actually triggers Davis-Bacon
The Davis-Bacon and Related Acts apply to contractors and subcontractors on federally funded or assisted contracts over $2,000 for the construction, alteration, or repair of public buildings or public works. Covered laborers and mechanics must be paid at least the locally prevailing wage and fringe benefits DOL sets for the classification of work performed, not a companywide average rate.
A second, separate rule layers on top for larger jobs. On prime contracts over $100,000, the Contract Work Hours and Safety Standards Act requires time and one-half for hours over 40 in a workweek for laborers, mechanics, guards, and watchmen, on top of whatever the prevailing wage determination already requires.
The weekly certified payroll and the Statement of Compliance
The Copeland Act and 29 CFR 5.5(a)(3)(ii) require covered contractors and subcontractors to submit a certified payroll every week the contract is active. Form WH-347 is optional, but a Statement of Compliance carrying identical wording to the one on WH-347 must accompany each weekly submission regardless of the format used.
The Statement of Compliance is signed under 18 U.S.C. 1001: a fine, up to 5 years imprisonment, or both, for a false statement. A photocopied or scanned signature does not satisfy the requirement, but a legally valid electronic signature does. And privacy matters here too: full Social Security numbers must never appear on the form, only an identifying number such as the last four digits.
Meeting the fringe obligation
Fringe benefit obligations can be met through contributions to bona fide benefit plans, cash paid in lieu of fringes, or a mix of both. Unfunded plans need prior DOL approval under 29 CFR 5.28, and any payroll deduction that is not on the list in 29 CFR 3.5 needs prior DOL approval before it can be taken from a covered worker's pay.
What BEG runs every week
BEG runs the weekly payroll inside the client's system with hours split by project and labor classification, the prevailing base rate and the fringe credit or cash-in-lieu amount coded separately, and the deduction detail the WH-347 columns require, then produces the weekly certified payroll data from that record. Pulling the correct wage determination, deciding fringe plan credits, signing the Statement of Compliance, and dealing with the contracting agency stay with the client and its counsel.
Full BEG managed payroll produces this weekly certified payroll record as a standard part of the service on covered jobs.

Frequently Asked Questions
What happens if hours are not tracked by labor classification?
The worker has to be paid the highest applicable rate for every hour worked that day, not just the hours actually spent on the higher-rated task. Splitting hours by classification is the only way to pay the correct blended rate.
What contracts does Davis-Bacon actually cover?
Contractors and subcontractors on federally funded or assisted contracts over $2,000 for the construction, alteration, or repair of public buildings or public works. Covered laborers and mechanics must be paid at least the locally prevailing wage and fringe benefits DOL sets for that classification.
Does prevailing wage overtime work differently than standard FLSA overtime?
On prime contracts over $100,000, the Contract Work Hours and Safety Standards Act adds its own requirement: time and one-half for hours over 40 in a workweek for laborers, mechanics, guards, and watchmen on the covered project.
Is Form WH-347 required for certified payroll?
No. WH-347 is optional, but a Statement of Compliance with identical wording to the form must accompany every weekly certified payroll submission regardless of which format is used.
Can a scanned signature be used on the Statement of Compliance?
No. The Statement of Compliance is signed under 18 U.S.C. 1001, carrying a fine, up to 5 years in prison, or both for a false statement. Photocopied or scanned signatures do not satisfy the requirement, though a legally valid electronic signature does.
How are fringe benefit obligations satisfied on a certified payroll job?
Through contributions to bona fide benefit plans, cash paid in lieu of fringes, or a mix of both. Unfunded plans need prior DOL approval, and any payroll deduction outside the list in 29 CFR 3.5 also needs prior DOL approval before it can be taken.
Can a certified payroll show a worker full Social Security number?
No. Full Social Security numbers must not appear on the certified payroll. Only an identifying number, such as the last four digits, is allowed.
What does BEG handle on a certified payroll job?
BEG runs the weekly payroll inside the client's system with hours split by project and labor classification, the prevailing base rate and fringe credit or cash-in-lieu coded separately, and the deduction detail the WH-347 columns need, then produces the weekly certified payroll data from that record, all inside standard managed payroll at $45 per employee monthly.
What does BEG managed payroll cost?
$45 per employee per month, all-inclusive, inside the payroll software you already use, or on BEG's isolved HCM at the same rate.
