Indiana Paid Sick Leave Explained: The Clause About Benefits
Indiana requires no paid sick leave, so the handbook is the enforceable rule. Its jury duty statute, Ind. Code section 35-44.1-2-11, goes further than most by prohibiting the deprivation of employment benefits and not only dismissal, so suspending benefit accrual during jury service is itself the violation.

Indiana has no paid sick leave statute, and no Indiana city runs an ordinance. The sick leave answer is therefore whatever the handbook says, and it is short.
The Indiana statute that does affect a leave policy is the jury duty provision, and it contains a clause most states leave out. It prohibits depriving an employee of employment benefits because of jury service, not merely dismissing them for it, which turns a common payroll practice into a criminal offence.
Indiana at a glance
| Paid sick leave mandate | None statewide for private employers |
|---|---|
| Governing rule | Your written policy, enforced as written |
| State paid family and medical leave | None. Federal FMLA only, unpaid, at 50+ employees |
| Minimum wage | $7.25 |
| Overtime | Weekly over 40 |
| Jury duty leave, paid? | Unpaid. No state requirement to keep paying during service. [Ind. Code § 35-44.1-2-11] |
| Jury duty, the part missed | The prohibition covers depriving an employee of employment benefits, not just dismissal, so suspending benefit accrual during service is itself the violation. |
| Jury duty penalty | Lost wages, reinstatement, attorney fee; Class B misdemeanour. |
| Coverage below the 20-employee COBRA line | Indiana Small Employer Group Health Insurance - Continuing Coverage, up to 12 months [Ind. Code section 27-8-15-31.1 (Continuing coverage), within the Small Employer Group Health Insurance chapter (IC 27-8-15)] |
Benefits, not just the job
Ind. Code section 35-44.1-2-11 reaches deprivation of employment benefits. The usual national practice of pausing accrual during an unpaid absence, so that leave, holiday or service credit stops building while somebody is away, is exactly the conduct that wording covers when the absence is jury service.
A payroll system that automatically freezes accrual on any unpaid absence code will therefore breach Indiana law without anybody making a decision. The fix is a separate absence code for jury service that leaves accrual running, which is a configuration change rather than a policy sentence.
The service itself is unpaid in Indiana. Remedies run to lost wages, reinstatement and attorney fees, and the offence is a Class B misdemeanour.
Continuation coverage is hidden in the small employer insurance chapter
Indiana does provide continuation below the federal COBRA threshold, but not in a statute called mini-COBRA. It sits at Ind. Code section 27-8-15-31.1, inside the Small Employer Group Health Insurance chapter, and gives continuing coverage for up to 12 months.
That placement is why Indiana employers often conclude there is no state continuation right. Searching for a continuation act finds nothing, because the obligation is a clause inside the law governing how small employer group health insurance works.
Indiana wage law reaches two employees
Indiana sets its minimum wage at the federal $7.25 but applies its own statute to employers with two or more employees, rather than relying only on the federal coverage test. Overtime is weekly above 40 hours with no daily premium.
For a leave policy that has one practical effect. A very small Indiana employer that falls outside federal Fair Labor Standards Act coverage is still inside the state wage statute, so the value of any paid hour it chooses to provide has a state floor underneath it.
The exposure sits outside Indiana
Illinois shares a border and mandates paid leave for any reason at every employer, with separate and larger ordinances in Chicago and Cook County. Michigan, one state north, runs the largest state cap in the country at 72 hours.
The obligation follows the employee's work location, so an Indianapolis or Fort Wayne business with one remote hire across either line has taken on a full accrual, notice and record-keeping regime with nothing in its own handbook to extend. Getting that policy right before the first accrual period closes is what HR outsourcing does.
FMLA, remote-hire exposure and voluntary policy drafting: paid leave fundamentals.
For Indiana specifically: nothing above is statutory in Indiana, so your written policy is the enforceable rule, the wage floor those hours are paid at is $7.25, and below the federal 20-employee COBRA threshold Indiana still requires continuation coverage for up to 12 months. HR outsourcing in Indiana keeps that in the handbook and in payroll.

Frequently Asked Questions
Does Indiana require paid sick leave?
No. Indiana has no statewide requirement for private employers, so whatever your handbook says is the enforceable rule, including on carryover and payout. Hours you do pay are paid at $7.25.
What pay rate applies to leave hours in Indiana?
Minimum wage in Indiana is $7.25. Overtime: Weekly over 40. Paid leave hours generally do not count toward the overtime threshold because they are not hours worked.
Does health coverage continue after separation in Indiana?
Federal COBRA applies at 20 or more employees. Below that, Indiana has its own continuation law, the Indiana Small Employer Group Health Insurance - Continuing Coverage, running up to 12 months (Ind. Code section 27-8-15-31.1 (Continuing coverage), within the Small Employer Group Health Insurance chapter (IC 27-8-15)).
Do Indiana employers have to pay for jury duty leave?
Unpaid. No state requirement to keep paying during service. The prohibition covers depriving an employee of employment benefits, not just dismissal, so suspending benefit accrual during service is itself the violation. Getting it wrong costs: Lost wages, reinstatement, attorney fee; Class B misdemeanour (Ind. Code § 35-44.1-2-11).
Does Indiana run a paid family and medical leave programme?
No. Federal FMLA is the only family and medical leave floor in Indiana: 12 workweeks, unpaid, at employers with 50 or more employees.
What does the Indiana jury duty benefits clause actually prohibit?
Depriving an employee of employment benefits because of jury service, not just dismissing them for it. Pausing benefit accrual, freezing a leave balance or treating the days as an unpaid break in service is the prohibited act on its own. Most state jury duty statutes only reach dismissal, so a national policy that suspends accrual during unpaid absence has an Indiana-specific problem.
Is jury duty paid in Indiana?
No. Indiana protects the job and the benefits but does not require the employer to keep paying. Enforcement runs to lost wages, reinstatement and attorney fees, and the offence is a Class B misdemeanour.
Does Indiana have state continuation coverage?
Yes. Ind. Code section 27-8-15-31.1, inside the Small Employer Group Health Insurance chapter, provides continuing coverage for up to 12 months for employees of small employers not reached by federal COBRA. It sits in the small employer insurance law rather than in a standalone mini-COBRA statute, which is why it is often missed.
Does Indiana wage law reach small employers?
Yes. Indiana state minimum wage law applies to employers with two or more employees, rather than adopting only the federal coverage test, and the rate matches the federal $7.25. Overtime is the weekly rule above 40 hours with no daily premium.
Is this a PEO?
No. No co-employment and no employer-of-record change: your company stays the employer. HR outsourcing, powered by isolved.
